PLANNING AND ZONING BOARD
NOVEMBER 9, 2009
CALL TO ORDER - ROLL CALL: Chairman R. Crawford called the Planning and Zoning meeting to order at 5:15 p.m. Zoning Board Members Beasley, B. Crawford, R. Crawford, Cason, Myers, City Attorney Maines, & City Manager Berchtold were present.
ITEM 1. APPROVAL OF THE AGENDA FORMAT
Motion made by Myers, second by Cason and carried unanimously to approve the agenda format.
ITEM 2. ADMINISTRATION OF OATH OF OFFICE TO THE LAND DEVELOPMENT ADMINISTRATOR
Attorney Maines administered the Oath to LDR Administrator Berchtold.
ITEM 3. APPLICATION # CPA 09-2, SOUTHERN PROFESSIONAL TITLE (FROM RESIDENTIAL MEDIUM TO COMMERCIAL)
A. City Manager Berchtold provided a report.
B. Comments from the Applicant were requested. Gerry Dedenbach of CHW (Causseaux, Hewett, & Walpole, Inc.), representing the client offered comments pertaining the requested change.
C. Public Hearing Comments
1. Chairman R. Crawford asked for comments from those in favor of the approval. Avery Roberts, Amber Roberts-Crawford, Darlene Logan, and Wilber Walters stated they were in favor of the approval.
2) Chairman R. Crawford asked for comments from those opposed to
the approval and there were none.
D. Board Comments
There were none.
E. Action upon the proposal.
Motion made by Myers to adopt Resolution PZ/LPA CPA 09-2 and to read by title only. Attorney Maines read the Resolution by title only, motion seconded by Beasley and carried unanimously.
ITEM 4. APPLICATION # LDR 09-3, SOUTHERN PROFESSIONAL TITLE (FROM RESIDENTIAL-OFFICE TO COMMERCIAL, CENTRAL BUSINESS DISTRICT).
A. City Manager Berchtold provided a report.
B. Comments from the Applicant were requested. Gerry Dedenback offered comments in favor of the request.

REGULAR MEETING
NOVEMBER 9, 2009
CALL TO ORDER - ROLL CALL:
Mayor R. Crawford called the meeting to order at 5:28 p.m. and read the following statement: “If a person decides to appeal a decision made with respect to any matter at this meeting or hearing, he will need a record of the proceedings and may need to ensure that a verbatim record is made”.
Commissioners Beasley, Brantley Crawford, Mayor Ray Crawford, Cason, Myers and were present.
Staff: City Attorney Maines, & City Manager Berchtold were present.
ITEM A. PLEDGE OF ALLEGIANCE - Mayor R. Crawford led the pledge of allegiance.
ITEM B. APPROVAL OF THE AGENDA FORMAT.
Motion made by Cason, second by Myers and carried unanimously to approve the Agenda Format.
Motion made by Cason, second by B. Crawford and carried unanimously to amend the Agenda Format to include Resolution 2009-15, Item 11.
ITEM C. PROVISION FOR CITIZEN INPUT
There were no public comments.
NEW PROCEDURE:
Pertaining to agenda items, if you wish to speak, please request permission from the Mayor. If granted, any questions should be directed to the Mayor. The Mayor shall decide who responds.

Motion made by Cason, second by Beasley and carried unanimously to approve the Consent Agenda.
ITEM 2. APPROVAL OF PAYABLES AND FINANCIAL REPORTS FOR OCTOBER, 2009
Motion made by Beasley, second by B. Crawford and carried unanimously to approve the Finance Report and Payables for October 2009.
ITEM 3. REPORT FROM PLANNING AND ZONING BOARD, RE: CPA 09-02, SOUTHERN PROFESSIONAL TITLE
Motion made by Myers to adopt Ordinance 2009-06 and to read by title only. Attorney Maines read the Ordinance by title only, motion seconded by B. Crawford and carried unanimously.
Motion made by Cason, second by Myers and carried unanimously to schedule final reading on December 14, 2009.
ITEM 4. REPORT FROM PLANNING AND ZONING BOARD, RE: LDR 09-03, SOUTHERN PROFESSIONAL TITLE
Motion made by Myers to adopt Ordinance 2009-07 and to read by title only. Attorney Maines read the Ordinance by title only, motion seconded by Beasley and carried unanimously.
Motion made by Cason, second by B. Crawford and carried unanimously to schedule final reading on December 14, 2009.
ITEM 5. DONATION OF OLD FIRE TRUCK TO UNION COUNTY
Motion made by Beasley, second by B. Crawford and carried unanimously to donate the old fire truck to Union County.
ITEM 6. AWARD OF VACATION TIME TO CITY MANAGER
Motion made by Cason, second by B. Crawford and carried unanimously to grant/award City Manager Berchtold 1 additional week of vacation to be used during the 2010 budget year. (this time not to be cashed out)
ITEM 7. REQUEST OF MERCY MOUNTAIN BOYS TO PERFORM AT THE DEPOT ON FRIDAY, DECEMBER 11, 2009
Motion made by Cason, second by B. Crawford and carried unanimously to approve this event. City Manager Berchtold will check regarding liability insurance issues.
ITEM 8. SALE OF SOD TO THE GENERAL PUBLIC
City Manager recommends sale of sod to Union County residents at the rate of $45.00 per pallet plus tax. Monies received would go to the Sewer Fund.
Motion made by Beasley, second by B. Crawford and carried unanimously to approve the sale to the Union County residents.
ITEM 9. 2009 CHRISTMAS PARADE UPDATE
City Manager Berchtold provided an update on proposed 2009 activities.
Motion made by Beasley, second by B. Crawford and carried unanimously to approve the activities for 2009.
ITEM 10. INTERIM REPORT – LAKE BUTLER LAKE LEVEL
City Manager discussed correspondence received from Louis Mantini dated November 6, 2009. City Manager requested to follow up on all items.
Motion made by Beasley, second by B. Crawford and carried unanimously to request a fly over of the lake.
ITEM 11. RESOLUTION 2009-15 DIRECTING AND REQUIRING THE OWNERS OF PARCEL ON NW 3RD STREET (30-05-20-000-0120-0) TO CLEAR SAID LOT OF WEEDS AND AUTHORIZING THE CITY MANAGER AND CITY ATTORNEY TO ENFORCE SAID DIRECTIVE.
Motion made by Beasley to adopt Resolution 2009-15 and to read by title only. City Attorney Maines read the Resolution by title only, motion seconded by B. Crawford and carried unanimously.
REPORT OF CITY ATTORNEY
There was none.
AWARD PRESENTATION
Paul Sharon, Range Rider for ICMA (International City Managers Association) presented an award to City Manager Berchtold for 35 years of local government service.
REPORT OF CITY MANAGER
City Manager Berchtold informed the Commission regarding a proposed grant to change out pumps at Sewer Plant which will require less electricity.
COMMENTS OR REMARKS BY COMMISSION:
A. Vice-Mayor Cason requested
1. DOT to reevaluate speed limits on all state roads coming into city limits
2. City Manager Berchtold to put a work order system in place, assigning log numbers for calls, requests, etc. for City Hall. Requested this to be placed on agenda for December 2009.
3. Status of Holley construction of modular home.
4. Addressing the issue of grocery carts all over town.

Mayor Crawford adjourned the meeting at 6:20 p.m.
